Off-duty NYPD officer due in court in fatal crash



NEW YORK - An off-duty New York City police officer accused of driving drunk and fatally striking a woman is scheduled to appear in court.

Andrew Kelly will be arraigned Thursday in state Supreme Court in Brooklyn on charges including vehicular manslaughter and driving while intoxicated.

Prosecutors say Kelly hit Vionique Valnord with his SUV on Sept. 26 as she tried to hail a cab after a wedding reception.

Lawyer Arthur Aidala said a blood-alcohol test showed Kelly had no alcohol in his system. The test was administered seven hours after the incident.

Authorities say officers at the scene smelled alcohol on Kelly's breath, but he refused to take a breath test.

Kelly and two other officers have been suspended in the incident.
